While I don't know this for sure, presumably if they don't meet the deadlines set by the special master they asked for, they won't get the privilege review of the documents they requested. Otherwise there are no consequences. The consequences will come if and when a criminal case is filed.

The DoJ has met its deadline to file a declaration or affidavit as to whether the Detailed Property Inventory, represents the full and accurate extent of the property seized from the premises located at
1100 S. Ocean Boulevard, Palm Beach, Florida 33480 (the “Premises”) on August 8, 2022, excluding documents bearing classification markings (the “Seized Materials”), filing a affidavit from the special agent in charge of the search, with his or her name redacted. The really interesting deadline is Friday, September 30, when Trump's team is required to

submit a declaration or affidavit that includes each of the following factual matters:
a. A list of any specific items set forth in the Detailed Property Inventory that Plaintiff asserts were not seized from the Premises on August 8, 2022.
b. A list of any specific items set forth in the Detailed Property Inventory that Plaintiff asserts were seized from the Premises on August 8, 2022, but as to which Plaintiff
asserts that the Detailed Property Inventory’s description of contents or location within the Premises where the item was found is incorrect.
c. A detailed list and description of any item that Plaintiff asserts was seized from the Premises on August 8, 2022, but is not listed in the Detailed Property Inventory.
This submission shall be Plaintiff’s final opportunity to raise any factual dispute as to the completeness and accuracy of the Detailed Property Inventory

In other words, either state under oath that the FBI planted evidence or forever shut the fuck up about it.

Trump's lawyer Jim Trusty (sans the apparently $3 million man) filed an incredibly pithy response to the DoJ letter, including attaching his previous letter with objections that he had tried to keep private until the DoJ publicly responded to it. As Andrew Weissmann says,

And, not surprisingly, Judge Cannon has given Trump what he wants, and basically slapped down the special master that she appointed after Trump suggested him, a federal judge with 30 years more experience than she has.

Lots of legal observers were saying yesterday that Dearie's plan put Trump in such a bind -- basically Trump would have had to admit that he had documents belonging to the government in his possession -- that Trump soon would drop his suit. But the commentator most frequently cited here lately warned that such takes were naïve and that Cannon had plenty of tricks yet to play. She was right.

Wheeler said a week or more ago that Cannon will probably end up firing Dearie, and as you've probably seen, Wheeler wrote just now that "things are going to get contentious and it's likely he'll be fired," and that she thinks Dearie would rather be fired than quit.
