Marvin Gaye's estate sued Robin Thick last year because mega-hit "Blurred Lines" sounded a lot like one of his songs and the estate won. Even though it was not at all a direct copy or a cover - it just had an very similar sound - that was enough for them to lose. So yeah, I'm sure you have to get permission to sell direct covers.

This is a good example of what I was asking about last page. Quinn has covers of all sorts of stuff on youtube. It's possible, though unlikely, that he's acquired the rights for everything featured. Is this legal since he's not actually selling the covers? Because there are links from youtube to his website where he has other things for sale, so one could still argue he's using them to make money. Is that unimportant, or is he just gambling that no one will sue?

Two separate issues, I'm afraid, yov. The issue in the case being brought by Marvin Gaye's estate against Robin Thicke and Pharrell (which is ongoing; they haven't won yet, only passed a first procedural hurdle) is whether Thicke and Pharrell borrowed elements of Gayes's song without giving Gaye a writing credit (the same issue applies to the ongoing lawsuit against Led Zeppelin by the estate of Spirit frontman Randy Craig Wolfe for ripped off the chords for “Stairway to Heaven” from Spirit’s 1968 song “Taurus”. There is no issue of authorship when you cover someone else's song; the very nature of a cover is that you acknowledge that it is someone else's song. However, you do have to pay royalties in most cases for recording, releasing or publicly performing covers.

I would say rather that it is not about royalties but about a writing credit. Both of which stem from copyright law.

Thanks for those links, they are helpful. It sounds like in most cases people are probably just posting their videos and hoping the copyright holders decide that it's in their own best interests to allow them to stay up. And that artists are (probably) obtaining rights/paying royalties when and if they take the step of actually selling their covers.

I wonder, though--if Quinn ended up making millions in sheet music sales and the Game of Thrones crew decided they wanted a cut of the proceeds since he is using (possibly) unauthorized covers of their material to generate traffic to his site, would they have a case? Or would the fact that they declined to issue a takedown notice constitute acceptance? I think I'd be worried all the time if it was me.

As an aside, Quinn's Rohan theme absolutely does it for me - shivers and goosebumps up my back, just like the original orchestration.
Mornings wouldn't suck so badly if they came later in the day.
