While I am pleased with the primary result of the ruling, it is disappointing that the Court (which is say, Justice Kennedy) once again refused to say whether it believes that sexual orientation is classification which requires heightened scrutiny. The crux of Kennedy's opinion is that marriage is a fundamental right, and that refusing to allow same sex couples to marry the partner of their choice unconstitutionally infringes upon that right. While he also gives lip service to the idea that denying same sex couples the right to marry infringes upon their right to equal protection, he does so while still avoiding saying whether the standard should be rational basis or strict scrutiny. As far as I am concerned, under either standard their right to equal protection is infringed, because I don't believe their is any rational basis for banning same sex couples from marrying, but the result is that the door remains open to discriminating against people because of their sexual orientation with far greater impunity than because of their race, gender, age, etc.

There was no way on Earth they were going to go there, though, in the same case they swept away gay marriage bans. Not this court, not this majority.

I think that will be down the line a while. There is no hope, for instance, that ENDA (the Employment Non-Discrimination Act) which is designed to add sexual orientation and gender identity as classes protected from employment discrimination will pass any time in the foreseeable future (actually, after the Hobby Lobby decision, even some major LGBTQ groups withdrew support from ENDA because of fears that the religious exemptions written into it would sanction discrimination).

Even with marriage equality, the fight is over yet.

I suspect that in many of the most conservative states, there will be tremendous pushback, and downright refusal to follow this decision.

Meanwhile, Scott Walker calls for a Constitutional amendment to allow states define marriage. I doubt that he'll get any farther than talking about it.
If there was anything that depressed him more than his own cynicism, it was that quite often it still wasn't as cynical as real life.

Aren't constitutional amendments difficult to get through the legislature in the US. That might just be my perception as the US has a handful of amendments, compared to India.
